Abstract

The article approaches the question of how deep is the crisis of the bolivian justice system. That, in addition, has been recognized by the State authorities. The article also analyses the facts that caused the failure of the government solution on his attempt to elect magistrates of the higher courts. The inefficiency, the spread of bureaucracy and the dependence on other state branches, together with the unsucssesful attempt to achieve checks and balances, once the new justice administrators were elected. Also, it observes the low expertise, the low qualification and competence, the deficient technical criteria, principles and etic behavior. It also takes due account of methodological, procedural, technical and administrative issues that enlarge the legal system crisis, as e.g. the collapse of the Supreme Court, because of absence of a law that regulates the specialized jurisdiction of the administrative claims, which generated the present procedural/competence disorder. The article, also recommends, in urge to solve the crisis, the meritocratic election, as well as promotions and the decentralization of the judicial administration in accordance to the autonomic State.
