Summary This article analyses the precautionary measures established by the new Code of Civil Procedure. It is characterized by the precautionary process that incorporates anticipated or professional, generic and specific security granted by one party to another that fulfill a provision as a guarantee given by the applicant to ensure the obligation to compensate for possible damage. The study takes into consideration that the process is based on the principle of orality in judicial processes and the simplicity of procedures, replacing writ of procedures. Furthermore, it analyses the requirements of its application and responsibilities of one who dictates them. The hypothesis is that the part of the modernization of court proceedings has implications for international judicial assistance, and is consistent with the law of domicile and civil procedural law.
