Abstract

Summary This article is related to establishment of a new paradigm of State, which in the case of Colombia, is configured from the principle of the Social State of Law, which involves a profound transformation of the functions assigned to it. Relations between the State and the people within are modified the same way, because they constitute State imperatives for the respect of human dignity, equality, freedom, etc. Based on this change of the paradigm, this paper describes the qualitative elements (Constitutional State) and quantitative (State concerned about the welfare of people), that lead to the State, the functions corresponding guarantee rights of all, and the expansion of the State functions and within them are of special interest of the judge. They have been aimed at meeting some purposes, which have not yet been fully achieved or at least not enough to being able to discuss about the consolidation of this paradigm.
