Abstract The present work arises from the need to introduce the debate on the notarial function that creates law, taking into account the discussion on the direct application of the Convention on the rights of persons with disabilities approved by the UN in New York in the year 2006 and ratified by Bolivia in 2009. The research adopted a descriptive qualitative design applying historical, comparative and analytical method. The objective is to generate academic discussion in the legal community in the face of the evident lack of reform of the Civil Code and Plurinational Notary Law taking into account the scope of the Convention in Bolivia, formulating a proposal that allows responding to the evident needs in the notarial offices of people with disabilities and in addition to laying the foundations for a future legislative reform in Bolivia
