Abstract
AGUILAR VARGAS, Lindsay Verónica. Criminal investigation procedure and secondary victimization in relatives of murdered people. Tribunal [online]. 2024, vol.4, n.7, pp.25-39. ISSN 2959-6513. https://doi.org/10.59659/revistatribunal.v4i7.41.
The objective of this research was to determine the effects of the procedure in criminal investigation, regarding secondary victimization in family members of victims of murder crimes. Methodologically, it was mixed, exploratory and non-experimental in design. The technique for data collection was the survey with the interview instrument, applied to the population of 68 public prison officials and 3 family members who were secondary victims. The results revealed that the judicial process is a scenario of secondary victimization, a phenomenon typified by victimology as the abuse of power in the legal process, which leads to arbitrary disqualifications regarding the victim, recriminations and obstacles to the effectiveness of the service; and in the victim, the lack of knowledge as a valid interlocutor with the right to be informed and understood. It is concluded that there is excessive bureaucratization of the system, which causes slowness and delay in processes.
