ABSTRACT: The paper is aimed at giving an analysis of the child's participation in the hearing in the Spanish legal system. After a brief general introduction to the subject follows an account on when to hear to the child and how to conduct the hearing, also in the sense of who is to take part in the hearing and of the form of recording the hearing, It is also laid out who should determine the necessity of the hearing and decide on the direct participation of the child, as well as the role of experts The study concludes emphasizing that although the child has the right to be heard there is no fixed rule that indicates how this process should be carried out.
