Abstract
JOFFRE CALASICH, Fabio. La responsabilidad penal de personas jurídicas en la legislación penal boliviana anticorrupcion (Ley 1390). Rev. Jur. Der. [online]. 2023, vol.12, n.19, pp.49-72. ISSN 2413-2810.
Abstract This article provides a comprehensive analysis of the incorporation of the corporate criminal liability regime into the Bolivian criminal code. The study is conducted in two phases, examining the statutory situation prior to the introduction of non-criminal corporate liability and the subsequent changes brought about by the enactment of the "Ley de Fortalecimiento a la lucha contra la corrupcion." The analysis highlights that the Bolivian imputation model follows the connection or transference approach, similar to other legal systems. Additionally, the article explores the consideration of company manipulation for criminal purposes as a condition of liability against the corporation. Furthermore, the study discusses the placement of prevention models within the realm of penalties, rather than serving as exculpatory factors, as observed in other jurisdictions
