Abstract In this article, the author presents the role that should identify the victim in constitutional criminal justice. First, he states that the concept of criminal law -criminal justice- justifies its action through legalized violence. It turns out that violence is the means to solve the crime. Second, the author analyzes the concept of power and its execution, which is the main concern of criminal justice. Thirdly, he considers that criminological policy should be understood as a science that deals with preventive policy, social policy or security. Next, he analyzes the concept of the victim and the criminal justice system under the threshold of the value of dignity. Finally, the author analyzes the reparation to the victim as the compensation agreement between the perpetrator and the victim, which definitely involves the victim, the perpetrator and the administration of justice
