Abstract The intention of the present reflection is to demonstrate how between the facticity and the illusion of article 113-II of the Political Constitution of the State, the habitus of the violation of constitutional rights is being generated in Bolivia; through the analysis and heuristic observation of two cases for each traditional public function performed by the Constitutional Rule of Law, based on the dogmatic foundations. From which it is inferred that both rulers and ruled are internalizing or normalizing the violation of constitutional rights, as if it were something habitual and legitimate in the exercise of both power and rights
